Court Snubs Chakwera on Injunction Relief; MEC Free to Release Results On Day 8
It is finished, Malawians have spoken. Out going President Dr Lazarus Chakwera and his Malawi Congress Party (MCP) have lost two applications restraining the electoral body (MEC ) from announcing results and declaring the presidential winner.
Justices Howard Pemba and Macdonald Kalemba of High Courts dismissed the applications on Tuesday. Chakwera and his MCP were seeking an injunction and judicial review over Malawi Electoral Commission (MEC) failure to determine the party’s complaints on alleged electoral irregularities.
Chakwera’s predecessor President Elect, Professor Arthur Peter Mutharika of Democratic Progressive Party (DPP) is poised to win based on the announced official results from 24 councils and unofficial results from the remaining 12 councils.
Chakwera is likely to end on second position in the race. “Application for leave to apply for Judicial review is granted. However, an order restraining the respondent from declaring or publishing final presidential results is not granted.” Ruled Pemba
Earlier in the day, Justice Kalemba said it was unusual on law for the claimant to come before the court to seek an injunction when MEC has not yet established the winner according to the Constitution of Malawi.
MEC Director of Communication Sangwani Mwafulira has since indicated that the Commission is set to announce the final results and declare the winner on Wednesday afternoon around 2pm.
Meanwhile, President Dr Lazarus Chakwera has been urged by former president Dr Bakili Muluzi to concede the loss.
